Is Richard Subbio an honest man?

In 2001, Subbio is arrested for Forged Prescriptions, Insurance Fraud, Possession of Controlled Substances and Criminal Contempt. Shoddy crimes...One could say, he did something stupid in his past or possibly he was even innocent. However, he petitions to get an "expedited" expungment, permitted only if one has been denied "gainful employment". Let's take a look at Subbio's testimony (under oath) of the court proceedings in Philadelphia on July 6, 2004.

Q. I'm going to read it to you, Petitioner has been denied gainful employment until this arrest is expunged. Were you denied gainful employment? Yes or No.

A: "Yes, because I had to get it cleared off in order to take the job with the Federal Government."

Q: You don't consider the job you have with the City of Philadelphia to be gainfully employed?"

A: " I mean, I wanted to go for a job that was making more money, sir"

Q: This says you had no gainful employment.

A. "Again sir, I signed it. My attorney (J. Scott O'Keefe) did the paperwork...
